Terms of Use for the Yarny App

1. Provider and scope
The Yarny app is provided by Erik Che Kreinbucher, trading as Miktoya, Gaugerichtsweg 13a, 6832 Sulz, Austria, email yarny@miktoya.com (hereinafter "we").
These terms of use govern the use of the Yarny app. They apply when you install and use the app. For downloading the app via Google Play, the Google Play terms also apply in the relationship between you and Google.
2. Services
Yarny is an app for planning and managing knitting and crochet projects, patterns and yarn stash. The app is provided to you free of charge. It works without an account and without an internet connection; all data is stored locally on your device.
We continuously develop Yarny. Features may change, be added or be removed where there is an objective reason, for example for technical or legal reasons. You are not entitled to specific future features, to updates or to the app remaining available on Google Play permanently. You can continue to use a version that is already installed as long as it is compatible with your device.
3. Right of use
We grant you the non-exclusive, non-transferable right to use Yarny on your devices for private purposes and for your own professional purposes. You may not modify, decompile or redistribute the app unless this is expressly permitted by law.
Yarny contains open-source components. These are subject to their respective license terms, which take precedence over these terms of use to that extent.
4. Your data and backups
Your data is stored exclusively on your device. We have no access to it and therefore can neither restore nor back it up for you.
The app is excluded from Android's automatic data backup. If you uninstall the app, clear the app's storage, reset or lose your device, your data will be lost unless you have a backup. Please create regular backups using Yarny's backup feature and keep the backup file in a safe place outside your device. Note that the backup file is not encrypted.
The backup file contains your content, including photos and PDF files, as well as the currency and hourly rate settings. The app language and the appearance (light, dark or same as the system) are settings on your device and are not part of the backup.
When you restore a backup, the data currently stored in the app is replaced with the contents of the backup.
5. Content and third-party rights
You are responsible for the content you store in Yarny. This applies in particular to patterns, PDF files, images and photos. Patterns are often protected by copyright. Please only import, store, export and share content to the extent that you are entitled to do so, for example because you purchased the pattern and use it only for yourself.
If you store information about other people, such as body measurements, please make sure that the people concerned agree.
We do not acquire any rights to your content.
6. Calculations and information
Among other things, Yarny calculates yarn stock, yarn usage, working time and costs based on your input. Yarny shows amounts in the currency you choose without converting them. These results are intended as guidance. They are only as accurate as the data entered and do not replace tax, legal or business advice, for example when calculating sales prices. Please check important results before relying on them.
7. Liability
We are liable without limitation for damage caused by us intentionally or through gross negligence, and for damage resulting from injury to life, body or health.
Since we provide the app to you free of charge, we are not liable for other damage that we cause through slight negligence only. This exclusion of liability does not apply where mandatory statutory provisions, in particular those protecting consumers, provide otherwise.
Liability under product liability law and other mandatory statutory claims remain unaffected.
8. Changes to these terms of use
We may amend these terms of use with effect for the future if there is an objective reason to do so, for example new features or a change in the legal situation. The current version is available in the app and at miktoya.com/yarny/terms. We will inform you about material changes in the app. If you do not agree with a change, you can stop using the app at any time.
9. Termination
You can stop using Yarny at any time by uninstalling the app. If you want to keep your data, back it up first using the backup feature.
10. Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you have your habitual residence.
For consumers, the statutory places of jurisdiction apply. For businesses, the exclusive place of jurisdiction is the court having subject-matter jurisdiction at the provider's place of business.

1. Anbieter und Geltungsbereich
Die App Yarny wird angeboten von Erik Che Kreinbucher, handelnd unter der Geschäftsbezeichnung Miktoya, Gaugerichtsweg 13a, 6832 Sulz, Österreich, E-Mail yarny@miktoya.com (im Folgenden „wir“).
Diese Nutzungsbedingungen regeln die Nutzung der App Yarny. Sie gelten, wenn du die App installierst und verwendest. Für das Herunterladen der App über Google Play gelten zusätzlich die Bedingungen von Google Play im Verhältnis zwischen dir und Google.
2. Leistungen
Yarny ist eine App zum Planen und Verwalten von Strick- und Häkelprojekten, Anleitungen und Garnvorräten. Die App wird dir unentgeltlich zur Verfügung gestellt. Sie funktioniert ohne Konto und ohne Internetverbindung; alle Daten werden lokal auf deinem Gerät gespeichert.
Wir entwickeln Yarny laufend weiter. Dabei können sich Funktionen ändern, hinzukommen oder wegfallen, wenn das sachlich gerechtfertigt ist, etwa aus technischen oder rechtlichen Gründen. Einen Anspruch auf bestimmte künftige Funktionen, auf Updates oder darauf, dass die App dauerhaft über Google Play erhältlich bleibt, hast du nicht. Eine bereits installierte Version kannst du weiter nutzen, solange sie mit deinem Gerät kompatibel ist.
3. Nutzungsrecht
Wir räumen dir das einfache, nicht übertragbare Recht ein, Yarny auf deinen Geräten für private Zwecke und für deine eigenen beruflichen Zwecke zu nutzen. Nicht gestattet ist es, die App zu verändern, zu dekompilieren oder weiterzuverbreiten, soweit dies nicht gesetzlich ausdrücklich erlaubt ist.
Yarny enthält Open-Source-Komponenten. Für diese gelten die jeweiligen Lizenzbedingungen, die insoweit diesen Nutzungsbedingungen vorgehen.
4. Deine Daten und Datensicherung
Deine Daten werden ausschließlich auf deinem Gerät gespeichert. Wir haben darauf keinen Zugriff und können sie deshalb weder wiederherstellen noch für dich sichern.
Die App ist von der automatischen Datensicherung von Android ausgenommen. Wenn du die App deinstallierst, den Speicher der App löschst, dein Gerät zurücksetzt oder verlierst, gehen deine Daten verloren, sofern du keine Sicherung hast. Bitte erstelle daher regelmäßig mit der Backup-Funktion von Yarny eine Sicherung und bewahre die Backup-Datei an einem sicheren Ort außerhalb deines Geräts auf. Beachte, dass die Backup-Datei nicht verschlüsselt ist.
Die Backup-Datei enthält deine Inhalte samt Fotos und PDF-Dateien sowie die Einstellungen Währung und Stundenlohn. Die Sprache der App und das Erscheinungsbild (hell, dunkel oder wie im System) sind Einstellungen auf deinem Gerät und nicht Teil des Backups.
Beim Wiederherstellen eines Backups werden die aktuell in der App gespeicherten Daten durch den Inhalt des Backups ersetzt.
5. Inhalte und Rechte Dritter
Für die Inhalte, die du in Yarny speicherst, bist du selbst verantwortlich. Das gilt insbesondere für Anleitungen, PDF-Dateien, Bilder und Fotos. Anleitungen sind häufig urheberrechtlich geschützt. Bitte importiere, speichere, exportiere und teile Inhalte nur, soweit du dazu berechtigt bist, zum Beispiel weil du die Anleitung erworben hast und sie nur für dich nutzt.
Wenn du Angaben zu anderen Personen speicherst, etwa Körpermaße, achte bitte darauf, dass die betroffenen Personen damit einverstanden sind.
Wir erhalten keine Rechte an deinen Inhalten.
6. Berechnungen und Angaben
Yarny berechnet unter anderem Garnbestände, Garnverbrauch, Arbeitszeiten und Kosten auf Grundlage deiner Eingaben. Beträge zeigt Yarny in der von dir gewählten Währung an, ohne sie umzurechnen. Diese Ergebnisse dienen deiner Orientierung. Sie sind nur so genau wie die eingegebenen Daten und ersetzen keine steuerliche, rechtliche oder kaufmännische Beratung, etwa bei der Kalkulation von Verkaufspreisen. Bitte prüfe wichtige Ergebnisse, bevor du dich darauf verlässt.
7. Haftung
Wir haften unbeschränkt für Schäden, die wir vorsätzlich oder grob fahrlässig verursachen, sowie für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit.
Da wir dir die App unentgeltlich zur Verfügung stellen, haften wir für sonstige Schäden, die wir nur leicht fahrlässig verursachen, nicht. Dieser Haftungsausschluss gilt nicht, soweit zwingende gesetzliche Vorschriften, insbesondere zum Schutz von Verbraucherinnen und Verbrauchern, entgegenstehen.
Die Haftung nach dem Produkthaftungsgesetz und andere zwingende gesetzliche Ansprüche bleiben unberührt.
8. Änderungen dieser Nutzungsbedingungen
Wir können diese Nutzungsbedingungen mit Wirkung für die Zukunft ändern, wenn dafür ein sachlicher Grund besteht, etwa bei neuen Funktionen oder einer geänderten Rechtslage. Die jeweils aktuelle Fassung findest du in der App und unter miktoya.com/yarny/terms. Über wesentliche Änderungen informieren wir dich in der App. Wenn du mit einer Änderung nicht einverstanden bist, kannst du die Nutzung der App jederzeit beenden.
9. Beendigung
Du kannst die Nutzung von Yarny jederzeit beenden, indem du die App deinstallierst. Sichere vorher deine Daten mit der Backup-Funktion, wenn du sie behalten möchtest.
10. Anwendbares Recht und Gerichtsstand
Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts und der Verweisungsnormen des internationalen Privatrechts. Bist du Verbraucherin oder Verbraucher, gilt diese Rechtswahl nur insoweit, als dir dadurch nicht der Schutz entzogen wird, den dir die zwingenden Bestimmungen des Rechts des Staates gewähren, in dem du deinen gewöhnlichen Aufenthalt hast.
Für Verbraucherinnen und Verbraucher gelten die gesetzlichen Gerichtsstände. Für Unternehmer ist ausschließlicher Gerichtsstand das am Sitz des Anbieters sachlich zuständige Gericht.
